Account & Contact Data: When you register on our website to use or download one of our products, or to subscribe to one of our services (eWAY Online, Free Trial, eWAY Apps, eWAY.sh, etc.), or fill in one of our contact forms, you voluntarily give us certain information. This typically includes your name, company name, email address, and sometimes your phone number, postal address (when an invoice or delivery is required),your business sector and interest in eWAY, as well as a personal password. We never record or store credit card information from our customers, and always rely on trusted third-party PCI-DSS-compliant payment processors for credit card processing, including for recurring payment processing.

Job Application Data: When you apply for a job on our website or via an employment agency, we usually collect your contact information (name, email, phone) and any information you choose to share with us in your introduction letter and Curriculum Vitae. If we decide to send you a job proposition, we will also ask you to provide extra personal details as required to fulfill our legal obligations and personnel management requirements. We will not ask you to provide information that is not necessary for the recruitment process. In particular, we will never collect any information about your racial or ethnic origin, political opinions, religious beliefs, trade union membership or sexual life.

Browser Data: When you visit our website and access our online services, we detect and store your browser language and geolocation in order to customize your experience according to your country and preferred language. Our servers also passively record a summary of the information sent by your browser for statistical, security and legal purposes: your IP address, the time and date of your visit, your browser version and platform, and the web page that referred you to our website. Customer Databases: When you subscribe to an eWAY Cloud service and create your own eWAY database (for example by starting a Free Trial), any information or content you submit or upload into your database is your own, and you control it fully. Similarly, when you upload an on-premises database to the eWAY Upgrade website, you own the data in it. This data will often include personal information, for example: your list of employees, your contacts and customers, your messages, pictures, videos, etc. We only ever collect this information on your behalf, and you always retain ownership and full control on this data.

In addition, if you interact with our Website, we use cookies and other technological tools to collect non-personal information, that may include, but is not limited to, your browser name, the type of computer you use and your use of our Website and applications. We may also collect technical information about your means of connection to our Website, such as the operating system and the Internet service providers utilized and other similar information. We collect this information to better understand the characteristics of people who visit our Website with a view to improving our services and the Website. How We Share Your Personal Information

Affiliates and Third Parties:

We may disclose Personal Information to our affiliated entities and our respective employees, contractors, consultants, service providers and other parties who require such information to assist us with managing our relationship with you and operating our organization, including third parties that provide services to us or on our behalf.

Storage and Processing:

Personal Information may be transferred to service providers who will store or process this information on eWAY's behalf. When we access or transfer Personal Information, we do so in compliance with applicable laws. Some of the data processors may be located outside Canada, in countries which may not have the same or substantially similar privacy laws as those set out in your jurisdiction, and accordingly, your Personal Information may not receive the same protections under the laws of such foreign jurisdictions, that it would in Canada.

eWAY works with iATS Payments (“iATS”) to process online donations to eWAY.

All Personal Information, other than your credit card or other confidential information related to your method of payment, collected by iATS for the purposes of processing your donation will be transferred to eWAY in order to provide appropriate tax receipts, in accordance with applicable legislation. The Personal Information collected by iATS will be subject to iATS' privacy policy, rather than this Privacy Policy. One Drop is not responsible for iATS' collection, use and disclosure of your Personal Information. We encourage you to consult iATS' privacy policy in order to better understand the risks associated with the use of these payment services.

Mergers:

In the event that eWAY is merged with another non-profit corporation or during the course of some other form of business combination, merger or joint venture, eWAY's Personal Information may be subject to review for such purpose by another party, such as our advisers, any prospective third party's advisers and the third party. Should eWAY or such other third party wish to use any Personal Information for purposes not described herein, then consent for such use of the information will first be obtained.

Enforcement & Prevention:

We may also share your Personal Information with third parties (including legal or administrative bodies, governmental authorities, jurisdictions) if we believe that disclosure is reasonably necessary to enforce this Privacy Policy, to detect or prevent fraud, security or technical issues or to comply with any applicable law, regulation, legal process or governmental request.



Retention of Personal Information

eWAY retains Personal Information for as long as needed in light of the purposes for which it was obtained and to comply with applicable laws. The criteria used to determine our retention periods includes whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them).

We may therefore retain your Personal Information for an additional period in archive databases, including for the duration of applicable statutes of limitation in order to be able to exercise our rights or defend ourselves in case of legal claims. Please note that if you merely unsubscribe from marketing communications such as the newsletter, we may nonetheless continue to use your Personal information for marketing and business analytics purposes, unless you withdraw your consent to this activity or object to it by contacting us at contact@eway.org with a mention “Legal/Privacy” in its subject line.

Accuracy of and Access to Personal Information

You have a right to access, correct or delete your Personal Information in eWAY's custody or control, subject to limited exceptions. We may require you to provide verification of your identity and to pay an administration fee to provide a copy of the information we hold.

In some circumstances, we may not be able to provide access to your Personal Information, for example if it contains the Personal Information of other persons, if it constitutes confidential business information, or if it is protected by solicitor-client privilege. We use, subject to your choice, Google AdWords and Display Network to advertise eWAY across the Internet. These services (commonly referred to as “remarketing” or “behavioral advertising” tools) rely on the use of cookies and other technological tools to track and analyze data, determine the popularity of content, deliver content and advertising targeted to you (including when you visit other websites), and to better understand your online activities. Our use of Google AdWords and Display Network allows us to tailor our marketing efforts to better suit your needs and to display advertisements which are believed to be relevant to you.
